Throughout these Terms, the words “LUV LUXE”, “we”, “us” and “our” refer to LuvLuxe Australia trading as LUV LUXE. The words “you” and “your” refer to any customer, visitor, buyer, seller, consignor or person using our website, store or services.
Our website is powered by Shopify, which enables us to provide our online store and related services.
By accessing our website, browsing our products, creating an account, placing an order, submitting an item for sale or consignment, contacting us, using layby, collecting an order, or otherwise using our services, you agree to these Terms & Conditions and any other policies linked on our website.
If you do not agree to these Terms, you must not use our website, purchase from us, sell to us, consign with us, or use our services.
Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law or any other law that cannot be excluded.

LUV LUXE is an Australian luxury resale business offering a curated selection of luxury and premium goods, including pre-owned handbags, watches, jewellery, footwear, accessories and other selected items.
Our services may include:
- online luxury resale
- in-store shopping
- click and collect
- consignment services

- layby and deposit arrangements

Many items sold by LUV LUXE are pre-owned, vintage, rare, discontinued, consigned or one-off pieces.

3. Eligibility and Website Use

- seller or consignor details

You agree that all information you provide is true, accurate, current and complete.
You are responsible for keeping your account login details secure. You must not share, sell, transfer or misuse your account.
We may refuse access, suspend an account, cancel an order or decline service where we reasonably believe there has been misuse, fraud, suspicious activity, false information, breach of these Terms or unlawful conduct.
5. Product Information
We make reasonable efforts to describe and photograph products accurately, including details such as:
- brand
- model or style
- colour
- material
- hardware
- size
- measurements
- inclusions
- condition
- visible signs of wear
- available paperwork or accessories
However, because many products are pre-owned, vintage, consigned or one-off resale pieces, condition can vary between items.
Product descriptions, condition ratings and photographs are provided as a guide. You should review all photos, videos, descriptions, measurements, condition notes and inclusions carefully before purchasing.
Colours, textures and finishes may appear slightly different due to lighting, photography, screen settings, camera exposure or device display.
Measurements are approximate and may vary slightly depending on the method used.
We may update, change, remove or discontinue products, descriptions, prices, images or listings at any time.
6. Pre-Owned and Luxury Resale Condition
Unless clearly stated otherwise, items sold by LUV LUXE are not brand new and may show signs of previous ownership, use, age, handling, storage, wear, repair, polishing or servicing.
Normal characteristics of pre-owned luxury goods may include:
- light scratches
- surface marks
- leather creasing
- leather softening
- corner wear
- edge wear
- glazing wear
- hardware scratches
- hardware tarnishing
- patina
- colour variation
- minor interior marks
- sole wear on footwear
- storage marks
- natural ageing of materials
- minor odour from storage or previous use
- shape loss from storage or use
- signs of previous cleaning, polishing, repair or servicing
These characteristics do not necessarily make an item faulty where they are consistent with the item’s age, condition, description, photographs, listing or pre-owned nature.
Condition ratings are subjective and provided as a general guide only. You should not rely solely on a condition rating.
7. Authenticity
LUV LUXE takes authenticity seriously.
We do not knowingly sell counterfeit goods. Items sold through LUV LUXE are reviewed for authenticity before sale, dispatch or final approval.
Our authenticity review may include internal inspection, product knowledge, serial or reference checks, material and hardware checks, market comparison, third-party authentication tools, Entrupy where available, or other specialist review depending on the item.
Where an item includes a LUV LUXE certificate, Entrupy certificate, third-party authentication report, brand paperwork, receipt, warranty card, dust bag, box or other inclusion, this will be stated in the product listing.
Unless specifically stated in the listing, original receipts, authenticity cards, certificates, boxes, dust bags, care booklets, spare parts, straps or other inclusions are not guaranteed.
LUV LUXE is not affiliated with, authorised by, sponsored by, approved by or endorsed by any designer brand, manufacturer or trademark owner whose products may be listed on our website, unless expressly stated.
Brand names, model names, logos and trademarks are used only to identify and describe the products.
Authenticity concerns after purchase are handled under our Returns, Refunds & Authenticity Guarantee.
8. Lifetime Authenticity Guarantee
LUV LUXE may provide a lifetime authenticity guarantee on authenticity only.
This means we stand behind the authenticity of items sold by LUV LUXE. It does not mean lifetime warranty for condition, wear, repair, servicing, water resistance, parts, damage, use, resale value or future performance.
If you have a genuine authenticity concern, you must contact us with supporting information so we can review the matter.
Where an item is confirmed not to be authentic, LUV LUXE will provide a remedy in accordance with Australian Consumer Law and our Returns, Refunds & Authenticity Guarantee.
9. Watches
Pre-owned watches may have signs of wear, previous polishing, unknown service history, battery age, timekeeping variation or parts replaced over time.
Unless clearly stated in writing, LUV LUXE does not guarantee:
- active manufacturer warranty
- water resistance
- future servicing requirements
- exact long-term timekeeping accuracy
- complete originality of all parts
- battery life
- future performance
- pressure testing
- availability of manufacturer service
- accuracy of previous service history
Water resistance can reduce over time and should not be relied upon unless the watch has been recently pressure tested by a qualified professional and this is clearly stated.
Customers are responsible for future servicing, testing, pressure testing, regulation, battery replacement, repairs and maintenance after purchase.

10. Jewellery, Diamonds and Gemstones
For jewellery, measurements, weights, metal details, stone details, carat weights, grading information and descriptions may be approximate unless accompanied by a formal laboratory certificate.
Gemstone, diamond and metal assessments may vary depending on the expert, laboratory, equipment, lighting, setting and method used.
Unless clearly stated, jewellery may be pre-owned and may show signs of wear, resizing, polishing, repair, previous setting work or natural characteristics.
Where a third-party valuation, appraisal, certificate or report is provided, LUV LUXE relies on the opinion of that provider and does not guarantee that another expert, laboratory or provider will reach the same opinion.
Third-party valuations, certificates and reports do not guarantee future resale value, insurance value or acceptance by another provider.

11. Orders
When you place an order with LUV LUXE, you are making an offer to purchase the selected item.
After placing an order, you may receive an order confirmation email. This confirms that your order has been received, but it does not guarantee that your order has been accepted, dispatched, released or that the item is available.
LUV LUXE reserves the right to accept, decline, cancel, refund, hold or review any order at our discretion where reasonably necessary, including where we believe there may be:
- suspected fraud
- unauthorised payment
- payment risk
- identity mismatch
- chargeback risk
- pricing error
- listing error
- stock error
- website error
- delivery risk
- product availability issue
- breach of these Terms
- suspicious or unusual activity
As many LUV LUXE items are one-off luxury resale pieces, availability can change quickly.
If an item becomes unavailable after purchase, we will contact you and arrange a refund or suitable alternative where possible.
Please review your order carefully before submitting it. Once an order has been accepted, processed, packed, dispatched or prepared for collection, cancellation may not be possible.
12. Prices, Errors and Availability
All prices are listed in Australian Dollars, unless otherwise stated.
Prices, discounts, promotions and availability may change without notice.
The price charged for a product will usually be the price displayed at the time the order is placed, unless there has been an obvious pricing error, technical error, listing error, promotional error or stock error.
We reserve the right to correct genuine errors, inaccuracies or omissions relating to pricing, product descriptions, condition, promotions, shipping charges, availability, measurements, inclusions or other listing details.
If an item has been incorrectly priced or listed, we may contact you, cancel the order and issue a refund.
We will not use this clause to mislead customers or avoid obligations that cannot be excluded under Australian Consumer Law.
13. Payment
You agree to provide current, complete and accurate purchase, payment and account information for all purchases.
You represent and warrant that:
- the payment information you provide is true, correct and complete
- you are authorised to use the payment method provided
- charges incurred by you will be honoured by your payment provider
- you will pay all charges incurred, including applicable shipping, fees and taxes
Payment must be received in full before an order is dispatched, released or collected, unless LUV LUXE agrees otherwise in writing.
We may accept payment by:
- credit card
- debit card
- bank transfer
- PayPal
- approved buy-now-pay-later services
- layby
- gift card
- store credit
- other payment methods shown at checkout
Some payment methods may be subject to third-party provider terms, approval, limits, fees, chargeback rules, fraud checks or processing times.
If payment is delayed, reversed, disputed, declined, flagged, held or not received, we may delay dispatch, cancel the order, request additional verification or refuse to release the item.
14. Payment Verification and Fraud Checks
Because LUV LUXE sells high-value luxury items, additional security checks may apply before dispatch, release or collection.
We may request:
- proof of identity
- proof of address
- payment verification
- billing address confirmation
- cardholder confirmation
- confirmation from the payment provider
- additional customer information
- written authority if someone else is collecting
We may cancel, delay, hold or refuse an order if we reasonably suspect fraud, unauthorised payment, identity mismatch, payment risk, chargeback risk or suspicious activity.
LUV LUXE may report suspected fraud, counterfeit goods, stolen goods, chargeback abuse or unlawful activity to relevant authorities, payment providers, insurers or affected parties where appropriate.
15. Layby and Deposits
LUV LUXE may offer layby on selected items at our discretion.
Layby is not automatically available on every item. Approval may depend on item value, item type, demand, consignment status and other business considerations.
Unless otherwise agreed in writing:
- the minimum layby deposit starts from 10% of the item price
- selected items may require a 20% deposit
- the maximum layby period is 30 days
- the item will not be released, shipped or collected until the full balance has been paid and cleared
- the item may be removed from sale while the layby is active
- layby deposits are non-refundable
- layby is not available once an item has sold to another customer
- LUV LUXE may refuse layby on selected items
If you miss a payment but the layby is still within the agreed 30-day period, you may continue paying. There is no automatic missed-payment fee simply for missing a payment within the agreed timeframe.
If the layby is not completed within the agreed timeframe, LUV LUXE may cancel the layby, retain the non-refundable deposit, and return the item to sale.
Any payments above the deposit may be reviewed case by case and handled in accordance with the agreed layby terms, applicable law and the circumstances of cancellation.
Layby items are held specifically for the customer, so cancellations and change-of-mind returns are limited. Layby items are not returnable for change of mind unless agreed by LUV LUXE in writing or required under Australian Consumer Law.
16. Shipping, Delivery and Collection
Shipping, delivery and collection are handled under our Shipping, Collection & Delivery Policy.
Customers are responsible for providing correct delivery and contact details.
For high-value items, LUV LUXE may require:
- tracked delivery
- insured delivery
- signature on delivery
- identity verification
- payment verification
- delivery to a verified address
- in-store collection instead of delivery
Where click and collect or in-store collection is offered, customers may be required to provide identification, order confirmation, payment verification and written authority if someone else is collecting.
Delivery timeframes are estimates only and may be affected by courier networks, customs, payment verification, high-value security checks, public holidays or events outside our control.
17. International Orders
International orders are handled under our Shipping, Collection & Delivery Policy.
Where international shipping is available, the customer is responsible for any customs duties, import taxes, GST/VAT, clearance fees, brokerage fees, government charges or other local costs payable in the destination country.
LUV LUXE is not responsible for customs delays, border inspections, import restrictions, seizure, additional charges or local delivery issues outside our control.
International customers are responsible for checking whether an item can legally be imported into their country before purchasing.
18. Returns and Refunds
Returns, refunds, exchanges, damaged items and authenticity concerns are handled under our Returns, Refunds & Authenticity Guarantee.
LUV LUXE complies with the Australian Consumer Law.
You may be entitled to a repair, replacement, refund or other remedy if an item has a major failure, is not of acceptable quality, is unsafe, is not as described, or otherwise fails to meet a consumer guarantee.
Due to the nature of luxury resale, pre-owned goods, consignment items and one-off inventory, LUV LUXE does not offer refunds, exchanges or returns for change of mind unless agreed in writing at the time of purchase or required by law.
Change of mind includes, but is not limited to, where a customer:
- changes their mind
- finds the item cheaper elsewhere
- decides they no longer want the item
- selects the wrong item
- selects the wrong size
- dislikes the colour, fit, shape or style
- did not read the description properly
- did not review the photographs properly
- expected the item to be brand new when it was listed as pre-owned
- experiences buyer’s remorse
Customers must contact LUV LUXE before returning any item. Items returned without approval may not be accepted.
19. Selling or Consigning With LUV LUXE
If you submit an item for sale, quote, direct buy-out, authentication review or consignment, you agree to our Selling, Consignment & Inspection Policy.
By submitting an item, you warrant that:
- you are the legal owner of the item
- you have the right to sell or consign the item
- the item is authentic
- the item is not counterfeit, replica or fake
- the item is not stolen or unlawfully obtained
- the item is not subject to finance, security interest, pawn agreement, loan, dispute, claim or ownership issue
- all information you provide is true, accurate and complete
- you have disclosed any known faults, repairs, alterations, replacements or authenticity concerns
- you have disclosed any missing parts, documents or inclusions
LUV LUXE may refuse, return, withdraw, remove, decline, hold, inspect or reject any submitted item at our discretion where reasonably necessary.
Submitting an item does not guarantee that LUV LUXE will accept, purchase, list, consign or sell the item.
Any quote, estimate or suggested resale price is not a guaranteed sale price unless confirmed in writing by LUV LUXE.
Commission rates, seller fees and payout terms may change from time to time. Sellers should check the current seller information on our website or the terms provided at the time of acceptance.
20. Consignment Items Sold on Our Website
Some items sold by LUV LUXE may be offered on behalf of a consignor.
Where LUV LUXE sells an item on consignment, customers still purchase through LUV LUXE and are entitled to applicable rights under Australian Consumer Law.
Consigned items may be one-off pieces and may not be replaceable.
Consignment items are subject to the same product condition, authenticity, returns, shipping and payment terms as other LUV LUXE items unless otherwise stated in writing.
21. Promotions, Discounts and Store Credit
Promotions, discounts, gift cards, store credits and vouchers may be subject to separate terms and conditions.
Unless stated otherwise, promotional codes cannot be:
- combined with other offers
- applied retrospectively
- exchanged for cash
- transferred
- used on excluded items
- used after expiry
- used on already discounted items
Store credit may have an expiry date where permitted by law and must be used according to the conditions provided.
LUV LUXE may cancel or refuse a promotion if it has been misused, incorrectly applied or affected by a technical error.
22. Gift Cards
Gift cards are subject to the terms displayed at the time of purchase.
Gift cards are not redeemable for cash and cannot be replaced if lost, stolen, damaged or used without permission, except where required by law.
Gift cards must be used before their expiry date where an expiry date is lawfully applied.
23. Intellectual Property
All website content, including images, product descriptions, branding, logos, text, graphics, videos, layouts, product reviews, designs and listings, is owned by or licensed to LUV LUXE.
You may use our website for personal, non-commercial shopping purposes only.
You must not copy, reproduce, distribute, scrape, download, modify, publish, sell, use or exploit our website content without written permission.

35. Indemnity

This may include courier delays, natural disasters, extreme weather, fire, flood, strikes, supply chain disruption, government restrictions, customs delays, technology failures, cyber incidents, payment provider outages or other events beyond our control.
37. Severability
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be enforceable to the fullest extent permitted by law, and the unenforceable part will be treated as severed from these Terms.
This will not affect the validity and enforceability of the remaining provisions.
38. Waiver and Entire Agreement
Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
These Terms and any policies or operating rules posted by us on this website constitute the entire agreement between you and LUV LUXE regarding your use of our website and services.
Any ambiguities in the interpretation of these Terms will not be construed against the drafting party.

This Shipping, Collection & Delivery Policy applies to orders placed with LuvLuxe Australia, ABN 12 141 444 886, trading as LUV LUXE.
Throughout this Policy, “LUV LUXE”, “we”, “us” and “our” refers to LuvLuxe Australia trading as LUV LUXE. “You” and “your” refers to the customer, purchaser, recipient or person collecting an order.
By placing an order with LUV LUXE, you agree to this Shipping, Collection & Delivery Policy, together with our Terms & Conditions, Returns, Refunds & Authenticity Guarantee, Privacy Policy and any other policies published on our website.
LUV LUXE sells curated luxury resale goods, including pre-owned, vintage, rare, one-off and consignment items. Because many items are high-value and not easily replaceable, additional shipping, payment, identity and security checks may apply.
Nothing in this Policy excludes, restricts or modifies any rights you may have under the Australian Consumer Law or any other law that cannot be excluded.

9. Tracking

10. Signature on Delivery

If signature on delivery is required, the item will only be delivered when someone is available to sign for it.
Once an item has been delivered to the nominated address, collected, or signed for by the customer or an authorised representative, the order is considered delivered, subject always to any rights that cannot be excluded under Australian Consumer Law.
Customers should ensure the delivery address is safe, attended and suitable for receiving high-value goods.
11. Authority to Leave
For security reasons, LUV LUXE may not allow authority to leave for high-value, rare, luxury or international items.
If a customer requests or authorises a parcel to be left unattended, the customer accepts responsibility for any loss, theft or damage after the parcel has been delivered, subject to any rights that cannot be excluded under Australian Consumer Law.
LUV LUXE may refuse authority to leave where we believe it creates delivery, insurance or security risk.
12. Insurance
Where appropriate, LUV LUXE may use insured shipping for selected high-value orders.
Insurance availability may depend on:

13. Lost, Delayed or Damaged Parcels

14. Click & Collect / In-Store Collection
Where click and collect or in-store collection is offered, customers may be required to provide:

- any additional verification reasonably required for high-value orders
LUV LUXE may refuse collection if we cannot reasonably verify the purchaser’s identity, payment details, cardholder authority or authority to collect.
Once an item has been collected by the customer or an authorised representative, the order is considered received.
15. Someone Else Collecting Your Order
A customer may request for another person to collect an order on their behalf.
For security reasons, LUV LUXE may request:
- written authority from the purchaser
- the purchaser’s full name and order number
- photo ID of the person collecting
- order confirmation
- proof of purchase
- verification of the payment method used
- photo ID of the original purchaser or cardholder

16. Store Viewing and Item Availability
Some items may be available to view in store, but not all items listed online are held at our physical location.
Some consignment items may still be with the consignor until sold.
If you are visiting LUV LUXE to view a specific item, please contact us before coming in so we can confirm whether the item is available for inspection.
LUV LUXE is not responsible if a customer visits without confirming availability and the item is unavailable, sold, held off-site, pending sale or not suitable for immediate viewing.
17. Pre-Owned, Rare and Consignment Items
Many LUV LUXE items are pre-owned, vintage, rare, one-off or consigned items.
Because these items may not be replaceable, shipping, security and verification checks may be stricter than standard retail orders.
LUV LUXE may choose the safest delivery or collection method based on:

- rarity
- condition
- size
- fragility
- insurance availability
- delivery location
- fraud risk
- payment method
- courier suitability
Some items may require collection, additional verification or a specific shipping method.
18. Refused, Returned or Unclaimed Deliveries

20. Risk and Delivery Completion
Risk in the item passes to the customer once the item has been delivered to the nominated address, collected by the customer, collected by an authorised representative, or signed for on delivery, subject always to any rights that cannot be excluded under Australian Consumer Law.

1. Australian Consumer Law
LUV LUXE complies with the Australian Consumer Law.
You may be entitled to a repair, replacement, refund, compensation or another remedy if an item has a major failure, is not of acceptable quality, is unsafe, is not as described, or otherwise fails to meet a consumer guarantee.
A store policy cannot remove your consumer guarantee rights.
However, customers are generally not entitled to a refund, exchange or return simply because they change their mind, find the item cheaper elsewhere, choose the wrong item, select the wrong size, or decide they no longer want the item.
2. No Change-of-Mind Returns
Due to the nature of luxury resale, pre-owned goods, vintage items, consignment stock and one-off inventory, LUV LUXE does not offer refunds, exchanges or returns for change of mind unless agreed by us in writing at the time of purchase or required by law.
This includes, but is not limited to, where a customer:
- changes their mind
- finds the item cheaper elsewhere
- decides they no longer want the item
- selects the wrong item
- selects the wrong size
- dislikes the colour, fit, style, shape or feel
- did not read the description properly
- did not review the photographs properly
- expected the item to be brand new when it was listed as pre-owned
- no longer requires the item
- experiences buyer’s remorse
- purchases the item as a gift and the recipient does not want it
- purchases an item and later decides it does not suit them
Please review all photographs, videos, descriptions, measurements, condition notes and inclusions carefully before purchasing.
3. Pre-Owned and Luxury Resale Items
Most LUV LUXE items are pre-owned, vintage, rare, discontinued, consigned or one-off resale pieces.
Customers acknowledge that pre-owned luxury items may show signs of previous ownership, age, use, handling, storage, repair, polishing or servicing.
Normal characteristics may include:
- light scratches
- surface marks
- leather creasing
- leather softening
- corner wear
- edge wear
- glazing wear
- hardware scratches
- hardware tarnishing
- patina
- colour variation
- minor interior marks
- sole wear on footwear
- natural ageing of materials
- signs of previous polishing
- signs of previous cleaning or servicing
- slight odour from storage or previous use
- loss of shape from storage or use
- minor marks from handling or display
These characteristics do not necessarily make an item faulty where they are consistent with the item’s age, condition, description, photographs, listing or pre-owned nature.
Condition ratings are provided as a general guide only. Customers should review all photographs, descriptions, measurements, condition notes and inclusions before purchasing.
4. Disclosed Condition Issues
Returns will not be accepted where the issue was clearly disclosed before purchase, including in:
- product descriptions
- product photographs
- condition notes
- videos
- messages
- invoices
- staff communication
- listing details
- social media communication where relevant
This applies unless there is a separate fault, issue or misdescription that was not disclosed.
For example, if a listing clearly shows corner wear, hardware scratches, patina, leather creasing or interior marks, those disclosed signs of wear are not considered a reason for return.
5. Product Photos, Colours and Measurements
LUV LUXE makes reasonable efforts to photograph and describe items accurately.
However, colours, textures, finishes and product appearance may vary slightly due to:
- lighting
- photography
- screen settings
- camera exposure
- device display differences
- natural material variation
- item age and use
Measurements are approximate and may vary slightly depending on the measuring method used.
A small variation in colour, lighting, texture, finish or measurement will not usually be considered a fault or misdescription where the item is otherwise consistent with the listing.
6. Faulty, Incorrect or Misdescribed Items
If you believe your item is faulty, incorrect, significantly different from the description, or has an issue that was not disclosed, please contact LUV LUXE as soon as possible.

LUV LUXE has the right to assess the item before providing a remedy.

7. Damaged on Arrival
If your item arrives damaged, please contact LUV LUXE as soon as possible.

- photos of the shipping label
- a description of the damage
- any courier information available
Do not dispose of the packaging, labels, courier documents or damaged item until the matter has been reviewed.
We may need to lodge an investigation with the courier, postal provider or insurance provider.
LUV LUXE will assess the matter in accordance with the courier investigation, our records, insurance requirements and your rights under Australian Consumer Law.

LUV LUXE takes authenticity seriously.

Every item sold through LUV LUXE must pass our authenticity review before final sale, dispatch or approval.

9. LUV LUXE Lifetime Authenticity Guarantee
LUV LUXE may provide a lifetime authenticity guarantee on authenticity only.
This means we stand behind the authenticity of items sold by LUV LUXE.
The lifetime authenticity guarantee does not cover:
- change of mind
- normal wear and tear
- condition issues disclosed before purchase
- future servicing needs
- repairs or alterations after purchase
- damage after purchase
- misuse or poor storage
- loss of value
- resale value
- buyer preference
- water resistance
- watch performance
- battery life
- jewellery resizing
- gemstone grading differences
- future brand policy changes
- future resale platform decisions
- third-party opinion changes without supporting evidence
If you have a genuine authenticity concern, you must contact us with supporting information so we can review the matter.
Where an item is confirmed not to be authentic, LUV LUXE will provide a remedy in accordance with Australian Consumer Law.
10. LUV LUXE Certificates and Entrupy
Where available and appropriate, LUV LUXE may provide:
- a LUV LUXE authenticity certificate
- an authenticity guarantee card
- an Entrupy certificate
- a third-party authentication report
- brand paperwork
- receipts
- service papers
- warranty cards
- other supporting documents
Not every item will include the same documentation.
Entrupy authentication may be provided on eligible items where possible. Availability depends on the brand, item category, item type and whether the item is supported by Entrupy.
If an item includes a certificate, report, receipt, box, dust bag, authenticity card, spare links, strap or other inclusion, this will be stated in the product listing.
Unless specifically stated in the listing, original receipts, authenticity cards, certificates, boxes, dust bags, care booklets, spare parts, straps or other inclusions are not guaranteed.
11. Authenticity Concerns After Purchase
If you have a genuine authenticity concern after purchase, you must contact LUV LUXE promptly.
Please provide:
- your order number
- your full name
- detailed photographs of the item
- a written explanation of the concern
- any third-party authentication report
- any supporting information
- confirmation that the item has not been altered, repaired, damaged, tampered with or switched after purchase
LUV LUXE may require:
- return of the item for assessment

- review by a third-party authentication provider
- review by a specialist
- comparison with original listing photos and records
- confirmation that the returned item is the same item originally sold
Authentication opinions can vary depending on the provider, method, information available, technology used and timing of assessment.
A third-party opinion does not automatically mean an item is not authentic. LUV LUXE will review the concern and supporting evidence carefully.
Where an item is confirmed not to be authentic, LUV LUXE will provide a remedy in accordance with Australian Consumer Law.
12. Items Must Not Be Altered or Switched
For any approved return, refund, authenticity review or claim, the item must be the same item originally supplied by LUV LUXE.
LUV LUXE may refuse or limit a return, refund or authenticity claim where the item has been:
- switched
- altered
- repaired
- resized
- cleaned
- polished
- serviced
- damaged
- used in a way that changes its condition
- tampered with
- had tags removed where tags were attached
- returned with missing inclusions
- returned in a different condition from when supplied
This does not limit any rights that cannot be excluded under Australian Consumer Law.
13. Watches
Pre-owned watches may have signs of wear, previous polishing, servicing history, battery age, timekeeping variation or unknown service history unless expressly stated otherwise.
Unless clearly stated in writing, LUV LUXE does not guarantee:
- manufacturer warranty coverage
- water resistance
- future servicing requirements
- exact long-term timekeeping accuracy
- complete originality of all parts
- battery life
- future performance
- availability of manufacturer service
- accuracy of previous service history
- pressure testing
- future repair costs
Water resistance can reduce over time and should not be relied upon unless the watch has been recently pressure tested by a qualified professional and this is clearly stated in writing.
A return will not be accepted simply because a pre-owned watch later requires routine servicing, battery replacement, regulation, pressure testing or maintenance, unless required by Australian Consumer Law.
Customers are responsible for future servicing, testing, pressure testing, battery replacement, regulation, repair and maintenance after purchase.
14. Jewellery, Diamonds and Gemstones
For jewellery, measurements, weights, stone details, metal details, carat weights, grading information and descriptions may be approximate unless accompanied by a formal laboratory certificate.
Gemstone, diamond and metal assessments may vary between experts, laboratories, lighting, settings, tools and grading methods.
Unless expressly stated, jewellery may be pre-owned and may show signs of wear, resizing, polishing, repair, previous setting work or natural characteristics.
A difference in opinion between valuers, jewellers, appraisers, laboratories or authentication providers does not automatically entitle a customer to a refund unless the item is proven to be misdescribed, faulty or otherwise fails to meet a consumer guarantee.
Valuations, certificates and appraisals do not guarantee future resale value, insurance value or acceptance by another provider.
15. Return Eligibility
Where a return is approved by LUV LUXE, the item must be returned:
- in the same condition as supplied
- unused and unworn after delivery
- with all tags still attached where applicable
- with all boxes, dust bags, straps, links, certificates, receipts, authenticity documents, accessories and inclusions
- securely packaged to prevent damage in transit
- within the timeframe provided by LUV LUXE
LUV LUXE may refuse or reduce a refund where the item has been:
- used after delivery
- worn after delivery
- damaged after delivery
- altered
- repaired
- resized
- cleaned
- polished
- serviced
- tampered with
- had tags removed
- returned with missing inclusions
- returned in a different condition from when supplied
This does not limit any rights that cannot be excluded under Australian Consumer Law.
16. How to Request a Return

Customers are responsible for any customs duties, import taxes, brokerage fees, clearance charges, return shipping costs or local charges associated with an international return, unless required otherwise by law.
If an international return is incorrectly declared, refused, seized, abandoned, delayed or returned due to unpaid customs charges or incorrect documentation, LUV LUXE is not responsible for any resulting loss, cost or delay unless required by law.
19. Refunds
If a refund is approved, the refund will usually be processed to the original payment method.
Refunds may only be processed after the returned item has been received and inspected, unless otherwise required by law.
Processing times may vary depending on your bank, payment provider or payment method.
Original shipping charges may not be refundable unless required by Australian Consumer Law or agreed by LUV LUXE in writing.
Where a refund relates to an international order, any refund may exclude customs duties, import taxes, brokerage fees or local government charges paid by the customer, unless required by law.
20. Exchanges
Because many LUV LUXE items are one-off, pre-owned, vintage, rare or consigned pieces, direct exchanges are usually not available.
Where appropriate, LUV LUXE may offer store credit or assist the customer in selecting another available item, but this is at our discretion unless required by law.
21. Store Credit
Where store credit is offered, it may be subject to separate conditions.
Store credit is not redeemable for cash unless required by law.
Store credit must be used in accordance with the conditions provided at the time it is issued.
22. Sale Items and Promotional Items
Sale items, discounted items and promotional items are subject to the same Australian Consumer Law protections as full-price items.
LUV LUXE does not offer change-of-mind returns on sale, discounted or promotional items unless agreed in writing at the time of purchase or required by law.
This does not affect your rights if the item has a major failure, is not of acceptable quality, is not as described, is unsafe, or otherwise fails to meet a consumer guarantee.
23. Layby Items
Layby items are held specifically for the customer.
LUV LUXE does not offer change-of-mind returns on layby items unless agreed in writing or required by law.
Layby deposits are non-refundable.
An item purchased through layby will not be released, collected or shipped until the full balance has been paid and cleared.
If a layby is not completed within the agreed timeframe, LUV LUXE may cancel the layby, retain the non-refundable deposit and return the item to sale.
Any payments above the deposit may be reviewed case by case and handled in accordance with the agreed layby terms, applicable law and the circumstances of cancellation.
24. Gift Cards
Gift cards are not redeemable for cash and cannot be refunded once purchased, except where required by law.
Gift cards must be used before their expiry date where an expiry date is lawfully applied.
Where required by Australian Consumer Law, gift cards will be valid for at least the minimum period required by law.
LUV LUXE is not responsible for lost, stolen or unauthorised use of gift cards, except where required by law.
25. Order Cancellations
Please review your order carefully before submitting it.
Once an order has been accepted, processed, packed, dispatched or prepared for collection, we may not be able to cancel it.
LUV LUXE may cancel an order where we reasonably believe there is:
- payment risk
- fraud risk
- pricing error
- listing error
- stock error
- delivery risk
- identity mismatch
- suspicious activity
- breach of our Terms & Conditions
If we cancel an order, we will arrange a refund where payment has already been received, unless we are legally entitled to take other action.

This Selling, Consignment & Inspection Policy applies to any person who submits, ships, drops off, consigns, sells, quotes, offers or presents an item to LuvLuxe Australia, ABN 12 141 444 886, trading as LUV LUXE.
Throughout this Policy, “LUV LUXE”, “we”, “us” and “our” refers to LuvLuxe Australia trading as LUV LUXE. “You” and “your” refers to any seller, consignor, owner, person submitting an item, or person dealing with us in relation to an item.
This Policy applies to items submitted to LUV LUXE for:
- direct buy-out
- instant sale
- consignment
- quote assessment
- authentication review
- valuation
- resale assessment
- inspection
- listing
- marketing
- sale
- any related service
By submitting an item to LUV LUXE, you agree to this Policy, together with our Terms & Conditions, Privacy Policy, Shipping, Collection & Delivery Policy, Returns, Refunds & Authenticity Guarantee, and any written consignment, buy-out or seller terms provided to you.
LUV LUXE takes authenticity, ownership, legal compliance and customer protection seriously. We do not knowingly accept, sell, market, consign, distribute or return to sale counterfeit, replica, stolen, unlawful or suspicious goods.
Nothing in this Policy excludes, restricts or modifies any rights or obligations that cannot be excluded under Australian law.
1. Selling Options
LUV LUXE may offer selected sellers one or more selling options depending on the item, brand, model, condition, value, market demand and business suitability.
Selling options may include:
- Instant Sale / Direct Buy-Out
- Consignment
- Quote or resale assessment
- Authentication or inspection review
- Other seller services approved by LUV LUXE
Not every item will qualify for every selling option.
Submitting an item does not guarantee that LUV LUXE will accept, purchase, consign, list, market, authenticate, return or sell the item.
LUV LUXE may refuse any item at our discretion where reasonably necessary.
2. Items We May Accept
LUV LUXE focuses on selected authentic luxury and premium items, including:
- designer handbags
- luxury watches
- fine jewellery
- selected designer accessories
- selected high-value or desirable luxury pieces
Acceptance depends on:
- brand
- model
- resale demand
- authenticity
- condition
- inclusions
- market value
- customer demand
- legal and ownership checks
- suitability for LUV LUXE customers
We may update the item categories we accept at any time.
3. Items We May Not Accept
LUV LUXE may refuse items that do not meet our standards or are not suitable for resale through our platform.
We may not accept items that are:
- counterfeit, fake, replica or unauthorised
- unable to be reasonably authenticated
- stolen, lost or unlawfully obtained
- subject to finance, loan, pawn agreement, lien, security interest, claim or ownership dispute
- significantly damaged
- heavily worn
- stained or discoloured
- affected by mould, pests, hygiene concerns or strong odour
- missing important parts or inclusions
- altered in a way that affects resale or authenticity
- repaired or restored without disclosure
- low-demand or unsuitable for our customer base
- not commercially viable to sell
- associated with unclear ownership
- supported by false, altered or unreliable documentation
- unsafe, unlawful or unsuitable for resale
LUV LUXE may also decline items due to market demand, price expectations, category limits, platform suitability or business risk.
4. Seller and Consignor Warranties
By submitting an item to LUV LUXE, you confirm and warrant that:
- you are the legal owner of the item
- you have the full legal right to sell, consign or submit the item
- the item is authentic
- the item is not counterfeit, fake, replica, imitation or unlawfully branded
- the item is not stolen, lost or unlawfully obtained
- the item is not subject to any ownership dispute
- the item is not subject to finance, loan, pawn agreement, security interest, claim, lien or encumbrance
- all information you provide is true, accurate and complete
- all photos you provide are current and accurate
- you have disclosed all known faults, repairs, alterations, damage, missing parts, authenticity concerns or ownership issues
- you have disclosed any known restoration, repainting, polishing, resizing, servicing, repairs or modifications
- you have not knowingly provided misleading photos, documents, receipts, certificates, serial numbers, stories or ownership history
- the item does not infringe any intellectual property rights, trademark rights, copyright rights or third-party rights
- submitting the item does not breach any law, agreement or third-party right
If any of these warranties are untrue, incomplete or misleading, LUV LUXE may refuse the item, cancel the quote or sale, withdraw the listing, return the item, report the matter, charge reasonable costs or take other action permitted by law.
5. Accuracy of Seller Information
You must provide complete and accurate information about your item.
This may include:
- brand
- model or style
- size
- material
- colour
- hardware
- condition
- serial number, date code or reference number
- purchase history where known
- ownership history where relevant
- repair or servicing history
- included accessories
- box, dust bag, receipt, certificate or paperwork
- known damage, marks, odour, wear or faults
- previous authentication reports
- any concern about authenticity or ownership
You must not hide, minimise or misrepresent any issue that may affect value, authenticity, saleability or customer satisfaction.
6. Seller Photos and Condition Disclosure
Photos submitted to LUV LUXE must be clear, current and accurate.
You should provide photos of all relevant areas, including:
- front
- back
- sides
- base
- interior
- corners
- edges
- handles or strap
- hardware
- brand stamps or logos
- serial numbers, date codes or reference numbers
- watch case, dial, caseback and bracelet
- jewellery hallmarks, clasps, stones and settings
- any wear, marks, damage or repairs
- any included box, dust bag, receipt, certificate, spare links, papers or accessories
Condition must be described honestly.
For handbags and accessories, you should disclose:
- marks, stains or discolouration
- corner wear or edge wear
- scratches, dents or scuffs
- cracking, peeling or glazing wear
- interior marks or lining wear
- hardware scratches, tarnishing or discolouration
- loose stitching or structural issues
- missing parts or broken zips, clasps or straps
- perfume, smoke, storage scent or other odour
- repairs, repainting, recolouring or alterations
For watches and jewellery, you should disclose:
- scratches, dents or signs of wear
- loose stones, missing stones or damaged settings
- tarnishing, fading or discolouration
- bracelet, chain or strap damage
- watch timekeeping issues
- battery or servicing issues
- servicing history where known
- resizing, polishing, repair or setting work
If the item condition differs from the submitted photos or description, LUV LUXE may revise the quote, cancel the sale, refuse the item, return the item or charge reasonable costs.
7. Quotes, Estimates and Valuations
Any quote, estimate, valuation, buy-out offer or consignment price provided by LUV LUXE is based on information available at the time.
This may include:
- photos
- condition
- inclusions
- brand
- model
- current demand
- recent resale data
- expected market value
- authentication confidence
- saleability
- business suitability
Quotes are preliminary unless confirmed in writing after inspection.
LUV LUXE may revise or withdraw a quote if:
- the item condition differs from photos
- inclusions are missing
- authenticity cannot be verified
- market value changes
- undisclosed faults are found
- the item has been repaired, altered or damaged
- ownership cannot be verified
- seller information is incomplete or inaccurate
- the item requires specialist inspection
- additional costs make resale commercially unsuitable
- the item is not suitable for LUV LUXE customers
No quote, estimate or proposed sale price is binding unless confirmed by LUV LUXE in writing.
8. Instant Sale / Direct Buy-Out
For Instant Sale or Direct Buy-Out, LUV LUXE may offer to purchase your item directly.
Any buy-out offer is subject to:
- physical inspection
- authenticity review
- condition check
- ownership verification
- inclusion check
- market value review
- business approval
Payment is only made once the item has been received, inspected, approved and authenticated by LUV LUXE.
LUV LUXE may revise, reduce or withdraw a buy-out offer if:
- the item does not match the submitted photos
- the item condition is different from what was disclosed
- inclusions are missing
- authenticity cannot be confirmed
- the item is found to be altered, repaired or damaged
- market value has changed
- ownership cannot be verified
- the item is unsuitable for resale
If a buy-out offer is declined or withdrawn, return shipping, insurance, authentication, inspection, handling or related costs may be the seller’s responsibility where applicable.
9. Consignment
Consignment means you still own your item while LUV LUXE helps market and sell it on your behalf.
Once the item sells and the transaction is completed, LUV LUXE deducts the agreed commission and any agreed costs, then pays you the remaining seller payout.
Consignment may involve:
- reviewing your item
- recommending a selling price
- preparing a listing
- marketing the item
- communicating with buyers
- arranging final inspection
- authenticating the item
- packaging and dispatching the item
- processing the buyer transaction
- paying the seller payout after completion
Consignment is not guaranteed. LUV LUXE may accept or refuse consignment at our discretion.
10. Keeping the Item Until It Sells
For selected consignment arrangements, the seller may keep the item until it sells.
This must be approved by LUV LUXE.
If the seller keeps the item during the listing period, the seller must:
- keep the item safe
- maintain the item in the same condition
- avoid using the item in a way that changes its condition
- notify LUV LUXE immediately if the condition changes
- notify LUV LUXE immediately if the item is lost, damaged, sold privately or no longer available
- provide updated photos if requested
- send or bring the item to LUV LUXE promptly once it sells
If the item is no longer available after a buyer commitment has been made, LUV LUXE may cancel the sale and take further action where reasonably necessary.
11. Item Must Match Listing and Photos
If an item sells through LUV LUXE, the item must match the photos, description, condition, inclusions and details provided to us.
If the item does not match the submitted photos or description, LUV LUXE may:
- cancel the sale
- update or remove the listing
- revise the selling price
- refuse the item
- return the item to the seller
- charge reasonable authentication, inspection, service, handling, postage, insurance or other expenses
- refuse future submissions from the seller
This includes where the item has:
- extra wear
- new damage
- missing inclusions
- undisclosed repairs
- authenticity concerns
- odour or storage issues
- different measurements
- different condition
- altered parts
- missing straps, links, documents or accessories
12. Seller Selling Privately or Losing the Item
If your item is listed with LUV LUXE and you sell it privately, lose it, damage it, gift it, withdraw it or make it unavailable, you must notify LUV LUXE immediately.
You should ask LUV LUXE to remove or mark the item as unavailable before committing to sell it elsewhere.
If a buyer has already committed to purchasing the item through LUV LUXE, cancellation may create business loss, customer dissatisfaction, payment issues or reputational harm.
LUV LUXE may take reasonable action where an item becomes unavailable after a buyer commitment.
13. Pricing and Price Changes
LUV LUXE may recommend a selling price based on:
- brand
- model
- condition
- inclusions
- current market demand
- recent resale data
- expected buyer interest
- rarity
- item value
- saleability
The seller may share a preferred price, but LUV LUXE may decline to list an item if the price expectation is not commercially suitable.
LUV LUXE may recommend price adjustments to help the item sell.
If an item has not sold within a reasonable time, LUV LUXE may recommend reducing the price, refreshing the listing, updating photos, changing marketing or ending the listing.
Any automatic price drop terms, if applicable, will be communicated through the seller page, quote, seller agreement or written approval.
14. Commission, Fees and Payout
LUV LUXE deducts commission from the final sale price for consignment items.
Commission rates, seller fees and payout terms may change from time to time. Sellers should check the current seller information on our website or the written terms provided at the time of acceptance.
The seller payout may be calculated based on:
- final sale price
- agreed commission
- agreed fees
- authentication costs where applicable
- shipping or insurance costs where applicable
- cleaning, repair or preparation costs where agreed
- any other agreed or applicable costs
LUV LUXE will confirm relevant seller terms before accepting the item for consignment or sale.
15. When Sellers Are Paid
Seller payout timing depends on the selling arrangement.
For Instant Sale or Direct Buy-Out, payment is made after the item has been received, inspected, approved and authenticated by LUV LUXE.
For consignment, seller payout is made after:
- the item has sold
- the buyer’s payment has cleared
- the item has been received by LUV LUXE where applicable
- the item has passed final inspection and authentication
- the item has been dispatched or collected
- the transaction has been completed
- any relevant return, dispute, fraud or payment risk has been cleared where applicable
LUV LUXE may hold or delay payout where there is:
- payment risk
- chargeback risk
- authenticity concern
- buyer dispute
- delivery issue
- item mismatch
- missing inclusion
- ownership concern
- suspected fraud
- legal or compliance issue
Seller payouts may be made by bank transfer, PayID, PayPal or another method approved by LUV LUXE.
16. Buyer Returns, Disputes or Cancellations
If a buyer raises an issue with a consigned item, LUV LUXE may review the item, listing, photos, seller information, buyer evidence and applicable consumer rights.
Where a buyer return, refund, cancellation, chargeback or dispute arises due to seller misrepresentation, undisclosed damage, missing inclusions, authenticity concerns, ownership issues or inaccurate information, the seller may be responsible for resulting losses, costs or expenses to the extent permitted by law.
This may include:
- refund costs
- return shipping
- authentication costs
- inspection costs
- handling costs
- payment dispute costs
- courier or insurance costs
- loss caused by inaccurate seller information
LUV LUXE will assess buyer issues reasonably and in accordance with our customer policies and applicable law.
17. Authentication Review and Inspection
LUV LUXE may inspect, assess, photograph, authenticate, research, test, compare, open, handle, review or seek third-party opinion on any item submitted to us.
This may include:
- physical inspection
- serial number, date code or reference number review
- stitching, material, hardware and construction checks
- receipt, certificate or paperwork review
- internal authenticity review
- third-party authentication review
- Entrupy where available
- brand database or market comparison where available
- specialist inspection for watches, jewellery or high-value goods
- professional watch caseback opening where required
- gemstone, diamond or metal assessment where appropriate
Authentication opinions are based on available information, inspection methods, expert opinion and technology available at the time of review.
LUV LUXE may refuse an item if authenticity cannot be reasonably confirmed.
18. Replica, Counterfeit or Suspicious Items
If LUV LUXE identifies, suspects or receives information that an item may be counterfeit, replica, fake, unlawfully branded, stolen, altered, misrepresented or otherwise unsuitable for resale, we may take reasonable action to protect our business, customers, brand partners and legal obligations.
Actions we may take include:
- refusing the item
- declining the quote, buy-out or consignment
- removing the item from sale
- cancelling any pending agreement
- holding the item while the matter is reviewed
- requesting further proof of ownership or authenticity
- obtaining third-party authentication or expert review
- returning the item to the owner at the owner’s expense, where appropriate
- surrendering the item to relevant authorities, brand representatives or rights holders where required or permitted by law
- disposing of or destroying the item where legally required, permitted, authorised or directed
- reporting suspected unlawful activity to relevant authorities, payment providers, platforms, insurers or affected parties
Counterfeit goods can raise serious legal issues. LUV LUXE will not knowingly return counterfeit goods into commercial circulation.
19. Right to Refuse or Withdraw Items
LUV LUXE may refuse, withdraw, return, hold or decline any item at our discretion, including where:
- authenticity cannot be confirmed
- the item appears counterfeit, replica or altered
- the item appears stolen or unlawfully obtained
- ownership is unclear
- documentation appears false or inconsistent
- the item condition differs from photos or information provided
- the item has undisclosed damage, repair or alteration
- the item does not meet our resale standards
- the item is not suitable for our customer base
- the seller’s price expectation is not commercially suitable
- the item may expose LUV LUXE to legal, financial, reputational or customer risk
We are not required to accept, list or sell any item simply because it has been submitted to us.
20. Inspection, Authentication, Handling and Return Charges
If an item is submitted to LUV LUXE and is later found or reasonably suspected to be counterfeit, replica, misrepresented, not as described, stolen, unlawfully obtained, unsuitable for resale or requiring additional inspection, the seller or consignor may be responsible for reasonable costs incurred by LUV LUXE.
Costs may include:
- authentication fees
- third-party expert fees
- Entrupy or authentication tool fees
- watchmaker inspection fees
- caseback opening fees
- jewellery inspection fees
- gemstone, diamond or metal testing fees
- shipping costs
- return shipping costs
- insurance costs
- handling fees
- packaging fees
- administration fees
- storage fees
- investigation fees
- cleaning or inspection preparation costs
- any other reasonable costs incurred due to the submitted item
The minimum charge for such costs starts from $150 AUD, but may increase depending on the item, category, value, location, shipping cost, insurance requirement, specialist review required, courier charges, professional fees and complexity of the matter.
For high-value items, watches, jewellery, international shipments or complex authentication cases, charges may exceed $150 AUD.
LUV LUXE may require payment of these costs before returning an item, where lawful and reasonable.
21. Shipping and Return of Refused Items
If LUV LUXE agrees to return a refused, declined, unsuitable or suspicious item to the seller or consignor, the item will be returned at the seller’s or consignor’s expense unless otherwise agreed in writing.
The seller or consignor may be responsible for:
- return shipping
- insurance
- signature delivery
- secure packaging
- customs duties or import charges
- courier fees
- handling fees
- authentication or inspection fees
- storage fees where applicable
LUV LUXE is not responsible for delays, loss, seizure, customs issues or damage once an item is returned using a courier or shipping provider, except where liability cannot be excluded by law.
If the seller does not pay return, handling, authentication, storage or related charges within the timeframe requested, LUV LUXE may continue to hold the item, charge storage fees or take further action permitted by law.
22. Watch Inspection and Caseback Opening
For watches, especially high-value watches, luxury watches, vintage watches and watches where authenticity or parts originality must be verified, LUV LUXE may require inspection by a qualified professional, watchmaker or specialist.
This inspection may include opening the caseback.
By submitting a watch to LUV LUXE, you authorise us, or a qualified professional engaged by us, to open the caseback where required for authentication, movement inspection, reference verification, parts review, service assessment or resale due diligence.
Caseback opening may be mandatory for selected high-end watches before LUV LUXE accepts, purchases, lists or consigns the watch.
The seller or consignor acknowledges that:
- some watches cannot be properly assessed without internal inspection
- opening the caseback may be required to verify authenticity, movement, reference, parts and condition
- only a qualified professional or suitable specialist should perform this process
- inspection may reveal issues not visible externally
- water resistance may be affected by age, seal condition or previous servicing
- pressure testing may be required separately if water resistance is claimed
- LUV LUXE does not guarantee water resistance unless expressly stated in writing after appropriate testing
Any professional inspection, caseback opening, resealing, pressure testing, authentication or watchmaker fees may be charged to the seller or consignor where applicable.
23. Jewellery, Diamond and Gemstone Inspection
For jewellery, diamonds, gemstones, precious metals and watches with stones, LUV LUXE may require additional inspection or expert review.
This may include:
- metal testing
- stone testing
- diamond or gemstone review
- weight verification
- setting inspection
- hallmark review
- valuation review
- laboratory certificate review
- specialist jeweller assessment
The seller or consignor acknowledges that jewellery and gemstone descriptions can vary depending on the expert, equipment, testing method, setting and available documentation.
If an item is found to be misrepresented, incorrectly described, treated, altered, synthetic, plated, lower grade than stated, not as represented or unsuitable for resale, LUV LUXE may refuse the item and charge reasonable inspection, authentication, handling and return costs.
24. False Documents, Receipts or Certificates
If a seller or consignor provides documents, receipts, certificates, valuations, authentication reports, warranty cards, serial numbers, photos or ownership information that appear false, altered, misleading, inconsistent or unreliable, LUV LUXE may refuse the item and take further action.
This may include:
- declining the item
- cancelling a quote or consignment
- retaining copies of supplied documents
- reporting suspected fraud or unlawful activity
- requesting further proof
- charging reasonable inspection, handling and return costs
- refusing future submissions from the seller or consignor
Supplying false, misleading or altered information may result in immediate rejection of the item.
25. Stolen or Unlawfully Obtained Goods
If LUV LUXE suspects an item may be stolen, unlawfully obtained, subject to dispute, subject to finance, or not legally owned by the person submitting it, we may refuse, hold, investigate, request further proof or report the matter where appropriate.
LUV LUXE may request:
- photo identification
- proof of ownership
- proof of purchase
- original receipt
- police report where relevant
- statutory declaration
- additional seller information
LUV LUXE will not knowingly buy, sell, consign or return items into commercial circulation where doing so may breach the law or expose our business, customers or third parties to risk.
26. Storage Fees and Uncollected Items
If an item is declined, refused, withdrawn or ready for return and the seller or consignor does not collect it, pay return charges, provide return instructions or respond to LUV LUXE within the requested timeframe, storage fees may apply.
Storage fees may apply from the date we notify the seller or consignor that action is required.
Storage fees may include reasonable costs for:
- secure storage
- insurance
- administration
- handling
- follow-up communication
- return preparation
If an item remains uncollected or unresolved for an extended period, LUV LUXE may take further action permitted by law, including continued storage, return at the owner’s expense, disposal where legally permitted or other lawful steps.
27. Marketing and Use of Item Photos
If your item is approved for consignment, direct sale, listing or resale assessment, you authorise LUV LUXE to photograph, list, advertise and market the item.
This may include use on:
- the LUV LUXE website
- social media
- email marketing
- paid advertising
- online marketplaces
- sales channels
- internal sales material
- customer enquiries
Your personal seller details will not be shown publicly to buyers.
Item photos and item information may remain in past marketing, archives, search results, social media or records even after the item has sold or been withdrawn, unless LUV LUXE agrees otherwise or is required by law.
28. Seller Privacy and ID Checks
For selected sellers, consignment items, buy-out offers or high-value transactions, LUV LUXE may request identification or additional seller information.
This may be used to:
- verify identity
- confirm ownership
- prevent fraud
- comply with legal obligations
- protect buyers and sellers
- manage payment and payout records
- investigate disputes or suspicious activity
Your personal information will be handled in accordance with our Privacy Policy.
Buyer-facing listings will not include your personal seller details.
29. Seller Cancellation or Withdrawal
A seller may request to cancel or withdraw a consignment before the item has sold, provided there are no active buyer commitments, pending transactions, accepted offers, agreed costs or other obligations already incurred.
LUV LUXE may refuse or delay cancellation where:
- a buyer has already purchased the item
- a buyer has made an accepted offer
- payment is pending
- the item is under dispute or review
- costs have already been incurred
- withdrawal would create loss, risk or customer issues
If cancellation is approved, the seller may be responsible for reasonable costs already incurred, such as authentication, photography, listing, marketing, shipping, handling, storage or inspection costs where applicable.
30. No Guarantee of Sale
LUV LUXE does not guarantee that any item will sell.
Resale outcomes depend on:
- brand
- model
- condition
- inclusions
- pricing
- buyer demand
- seasonality
- market conditions
- authenticity confidence
- presentation
- competition
- economic conditions
- platform performance
LUV LUXE may recommend price changes, updated photos, relisting, marketing changes or ending the listing if the item does not sell.
31. Seller Liability
The seller or consignor is responsible for any loss, claim, cost, fee, damage, charge, penalty, dispute or liability arising from:
- submitting a counterfeit, replica or fake item
- submitting a stolen or unlawfully obtained item
- providing false, incomplete or misleading information
- failing to disclose known faults, repairs, alterations or concerns
- providing false receipts, certificates or documents
- ownership disputes
- intellectual property infringement
- customer claims caused by seller misrepresentation
- courier costs, authentication costs or handling costs caused by the submitted item
- item condition not matching the photos or description
- item becoming unavailable after a buyer commitment
- missing inclusions or undisclosed changes
The seller or consignor agrees to indemnify LUV LUXE for losses, claims, costs or expenses arising from breach of this Policy, to the extent permitted by law.
32. Authority to Act
By submitting an item to LUV LUXE, you authorise LUV LUXE to take reasonable steps required to inspect, assess, authenticate, verify, photograph, store, transport, return, refuse, report, market, list, sell or otherwise manage the item in accordance with this Policy.
For high-value items, watches, jewellery, suspected counterfeit items, suspicious items or legally sensitive items, this may include engaging:
- third-party authentication providers
- Entrupy or similar tools where available
- watchmakers
- jewellers
- valuers
- couriers
- insurers
- legal advisers
- authorities
- brand representatives where appropriate
33. Seller Form Confirmation
When submitting an item to LUV LUXE, sellers and consignors may be required to confirm the following:
I confirm that I am the legal owner of the item, the item is authentic, and it is not counterfeit, stolen, financed, disputed or subject to any claim. I understand LUV LUXE may inspect, authenticate, refuse, return, hold, report or otherwise deal with the item in accordance with its Selling, Consignment & Inspection Policy. I agree that if the item is found or reasonably suspected to be counterfeit, replica, misrepresented, unsuitable or problematic, I may be responsible for inspection, authentication, handling and return costs starting from $150 AUD, which may increase depending on the item, shipping, insurance and professional fees.
For high-end watches, sellers and consignors may also be required to confirm:
For watches, I authorise LUV LUXE or a qualified professional engaged by LUV LUXE to open the caseback where required for authentication, movement inspection, reference verification, parts review or resale due diligence. I understand this may be mandatory for selected high-value watches and may involve additional professional fees.
34. Changes to This Policy
LUV LUXE may update this Selling, Consignment & Inspection Policy from time to time.
The current version will be published on our website.
If you submit an item after this Policy has been updated, the updated version will apply unless otherwise agreed in writing.
